Notable Cases

Violation: Murder Charge
Result: Case Dismissed
A client charged with murder made the unfortunate mistake of talking to the police prior to being represented and shared some very incriminating statements. This case was tried twice and Mr. Loftus represented this client for both trials. The first jury was deadlocked at nine for not guilty and three for guilty. The District Attorney wanted to proceed to a second trial which also resulted in a deadlocked jury with ten for not guilty and two for guilty.  The case was then dismissed. (People v Ramiro S., Ventura County)

Violation: Drug Sales and Conspiracy
Result: Probation
Mr. Loftus represented a client in a 28 defendant, 74 Count felony indictment for drug sales and conspiracy. The District Attorney believed our client to be one of the "main players." The case was resolved by a plea to one Misdemeanor count of Drug possession. The client was placed on probation and was released from jail without serving any time other than time served while awaiting trial. (People v George C.)

Violation: Murder Charge
Result: Life Without Parole
Mr. Loftus represented a client who was charged with Gang-related Murder with Special Circumstances after having confessed both to police and to the Grand Jury.  This charge made our client eligible for the Death Penalty. After a six month long trial, the jury was deadlocked at seven for "life" to five for "death".  The District Attorney declined to pursue a re-trial of the death sentence. (People v David Z., Ventura County)

Mr. Loftus notes that a fellow defense attorney who was familiar with the case commented, "I don't know how you saved your client.  Your client is a 'poster boy' for the imposition of the death penalty."
